New 8th Pay Commission Demand: Government Employees Ask for Absolute Freedom to Choose Between OPS, NPS, and UPS

The tertiary administration officials are raising a new, brave demand ahead of the final recommendations of the 8th Pay Commission – the choice of an individual pension scheme. The employee unions would like to see staff having the freedom of choice to join the Old Pension Scheme (OPS), the National Pension System (NPS) or the Unified Pension Scheme (UPS), depending on their individual financial requirements and risk appetite.

Why the Demand for Pension Choice Is Growing 

The push for government workers’ pension choice is based on a basic error in the present system: a one-size-fits-all pension policy is failing millions of workers. But employee federations say that there’s no one-size-fits-all answer to post-retirement security because a younger employee joining today is not the same as a worker nearing retirement after 30 years of service.

As per the existing provision, employees who are appointed after 1st January 2004 are compulsorily enrolled in the NPS, which is a market-linked scheme. Introduction of the Unified Pension Scheme (UPS) in 2025 by the government is a step taken towards implementing the guaranteed pension scheme, but several unions do not believe that the new scheme can match the benefits associated with the guaranteed, assured, and market-adjusted payout system under the Old Pension Scheme (OPS).

What Do the Employee Unions Demand?

The All India NPS Employees’ Federation (AINPSEF) made an official demand for establishing a timeframe for transferring all subscribers to the Old Pension Scheme based on providing a certain minimum number of years of service. The NPS UPS scheme seems to be increasingly popular among a few central employee unions and federations.

  • Military Option: Freedom to transfer to OPS scheme after meeting the years of service requirements.
  • The OPS scheme was in the jurisdiction of the 8th Pay Commission.
  • Recalculation of salaries based on the new minimum living expense formula based on current costs for a three-unit family household.

The NC-JCM Pension Proposal presented to the Pay Commission asserts that the security of retirement benefits for Government employees must consider their individual financial positions and not administrative ease.
