The Workers Rights 
According to Decree No. 337/2025/ND-CP and circular No. 08/2026/TT-BNV of Vietnam, the country has accounted for an electronic labor contract standard. A National Electronic Labor Contract Platform is put in operation, so that employers have to satisfy with provisions related to identity verification, digital signatures, timestamping, and central tracking of the contracts.
The framework takes companies with e-signature applications, and goes so far as to create a regulated digital labor practices arena for the signing and management of employment contracts.
Digital Authentication Becomes Mandatory
Electronic employment contracts are subject to certain requirements concerning their identity and technical requirements. Staff members working in Vietnam will be required to have Level 2 electronic identification (VNeID) or Citizen ID cards and foreign staff will be required to have a valid passport and documentation of their official entry.
The contracts should include a licensed Digital Signature Certificate and verified Timestamping Services. It should also be noted that both employees and employers have to go through licensed eContract providers which have points of connection to the National Electronic Labor Contract Platform.
24-Hour Reporting and Contract IDs
Once digitally executed and signed by both parties, the service provider validates the signatures, stamps them and then sends the contract information to the National Platform.
The work is to be finished within 24 hours from the latest possible deadline for the final execution of the work. The platform then generates a new Contract ID that is associated with the employment contract and can be further traced on the platform.
Salary amendments, appendixes to the contract, suspensions or termination notices should refer to the original Contract ID, and should not be stored independently.
Data Privacy and Retention Requirements
Employment details like addresses, remuneration, allowances and payment rules are all sensitive information, found in electronic contracts. Therefore, in the context of transferring the information of employees to vendors, or to or from other countries, the Vietnamese personal data protection law will be an important legal basis to be considered by the employer.
The provided framework stipulates that records from contracts, appendices and audit logs should be kept for 10 years after the end of the contract.
Key Actions for Employers
Businesses must check eContract providers’ licensing and their level of connectivity with the National Platform. HR should look through old e-contracts from before 2026 and take further action if they feel a verification or registration is needed.
It is also recommended that the businesses are kept up-to-date regarding changing a policy for electronic contracting, employee consent, data processing, or VNeID/passport verification.
