Sponsoring Expats in Vietnam: Work Permit Authority Shifts to Hanoi Doha

The HAN Doha has shifted responsibility on foreign labour management as per Decision No. 1052/QD-SNV. The change focuses on gathering the new applications of foreign nationals to work in Hanoi in the same place.

For some time now, People’s Committees at the local level will no longer accept the first foreign Work Permit applications. The employers are to make an application for a new expatriate applicant directly with Doha, since the company will be the sponsor of the applicant.

Who Handles Foreign Work Permit Applications?

Doha handles all matters related to new Work Permit applications, foreign labour report as well as labour utilisation plan. It also applies for canceling any permits issued by the department.

People’s Committees at local ward and commune levels have the authority to reissue, extend or cancel permits initially issued at local ward and commune levies. The employers are therefore obliged to find out the source authority before filling up renewal applications.

Five-Step Expat Sponsorship Process

1. Advertise the Position Publicly

The employer has to publish the announcement of the position in the workplace, for example on a company website, on a job platform and/or in the media, for at least 5 days. This requirement is a part of the new recruitment process for the job.

2. Submit the Unified Dossier

The Foreign Labor Demand statement plus Work Permit application must be submitted electronically via the Public Service Portal within 10 days or 60 days prior to the date jobs are scheduled to begin.

The common review will streamline the administration process, and it should take no longer than 10-15 working days to process the guidance, as supplied.

3. Prepare and Verify Documents

Qualifications and supporting documents must be presented by foreign candidates. In general, a professional background is required that includes the necessary experience, and specific appointment documentation is required for managers.

The criminal record checks should be conducted within six months and be legally stamped and translated. Basically, a medical certificate needs to be issued by a recognized medical facility within 12 months.

4. Sign the Labor Contract

Once the Work Permit is issued, the employer and employee should sign a labor contract that’s identical to the terms outlined on the Work Permit. A copy must then be submitted to Doha as required.

5. Apply for the Temporary Residence Card

There is a two-year Temporary Residence Card (TRC) which can be legalized following a Work Permit for eligible foreign employees to enter the country to follow a longer-term legal immigration procedure to Vietnam.

Compliance Checks Employers Should Not Miss

For enterprise in relation to government portal processes, employers will need to use enterprise Level 2 VNeID accounts. Also ensure that application forms are checked carefully to identify who is applying for a new application, namely Doha.

Failure to issue late foreign labor utilization and notification about location change in the workplaces may be fined up to VND 6 million per violation.
