What Can’t Outdoor Workers Do?

The UAE Summer Work Ban does not allow anyone to work outside, in open areas, in direct sunlight or high heat from 12:30 PM to 3:00 PM, every single day for 93 consecutive days. This is true for all companies, no matter how big they are, and all industries, from construction sites to landscaping to road work, etc.

No exceptions are given based on the day or week. The UAE Outdoor Work Ban is in effect all weekdays, weekends and even on public holidays.

What Can Outdoor Workers Do?

Employers are required to provide workers with a shaded or air-conditioned area during the middle of the day for resting, and these facilities should be allowed to be used by workers during this time. Normal working hours are usually divided into morning and evening shifts, and the workers still have to work the same number of hours, although not during the hottest periods.

Also, workers have the right to refuse to do outdoor work during ban hours without facing any disciplinary action and can report any violation straight to MOHRE

Who is Exempted from the UAE Summer Work Ban?

There are a limited number of jobs that do not apply because of technical or safety considerations, but the exemption does not mean that the duty of care is not applied:

Exempt ActivityWhy It’s Exempt
Rough in asphalt work (on-going)Not pausable without waste of material
Concrete pouringTo end the pour halfway through the process will result in loss of structural integrity.
Emergency utility repairsFailure of water, electric, or essential service.
Urgent traffic/public safety worksIf not stopped, it poses a threat to the safety of the public.

Although exempt from the provision of rest breaks, employers are still required to provide shade, water and hydration for exempt workers.

Are Delivery Riders Exempt?

The basic rule does not apply to delivery riders; they cannot work outside of doors between 12:30 PM and 3:00 PM. The UAE has, however, increased its support for this particular segment with more than 12,000 air-conditioned rest stations across the country for delivery drivers in the summer.

Employers’ Responsibilities Under the UAE Summer Work Ban

In addition to the midday stoppage, employers are required to:

  • Make shaded resting places at all worksites
  • Provide cold drinking water and hydration/electrolyte solutions as appropriate.
  • Install cooling equipment such as fans
  • Keep First Aid and basic welfare equipment available.
  • Post rules on the premises in the language(s) spoken by employees
  • MOHRE conducts planned and unannounced inspections, as well as digital monitoring.
