The summer heat in the UAE is not to be taken lightly – temperatures can reach 45°C and above by midday. That’s a major reason for the UAE Midday Break Rule. The 2026 ban enters into effect June 15 and continues until September 15, meaning that employers will not be able to have outdoor workers on the job between 12:30 PM and 3:00 PM.

What is the UAE Midday Break Rule?

The UAE Midday Break Rule is a regulation issued by the UAE Ministry of Human Resources and Emiratisation (MOHRE) which bans work outdoors and in open areas during the hottest hours of the day.  It is applicable to the government and private sector.

2026 Ban Hours:

  • Dates: June 15 – September 15
  • Restricted hours: 12:30 PM – 3:00 PM daily

This includes any work that is performed outside, from construction to delivery, landscaping to road work and more. This rule is applicable to those who work outside in the presence of the sun.

What does the employer need to do? 

The UAE Midday Break Rule 2026 is not only about halting work but also employers’ responsibilities to keep workers safe during summer:

  • Produce shade areas so that workers can take shelter from the sun.
  • Provide fans, cooling equipment and humidifiers.
  • Make sure there is always plenty of water to drink
  • Equip workers with the tools and supplies they need when they are working outside of ban hours

They are not a luxury service! They are mandatory and part of UAE Labour regulations 2026.

Are There Any Exceptions?

Yes — there are some exceptions in the UAE Midday Break Rule for work that really cannot be interrupted:

  • Technical necessity: Concrete pouring or asphalt paving that can’t be stopped in the middle of the process.
  • Public emergencies: repairs required to address water-related, power-related or traffic-related emergencies.
  • Permit-based work: Activities with an official government permit because of its effects on public life

These exceptions are rather limited. If your employer is claiming an ‘exception’ for regular work of construction or delivery, this is likely to be a sham.

What’s the Fine for Violating the Rule? 

Breaches of the UAE summer work ban could lead to significant financial repercussions for employers:

  • Dhs. 5000 for every worker who is working during ban hours
  • Any amount up to Dhs 50,000 if more than one worker is engaged

The compliance rate among the inspected companies was 99% last year, a positive sign with regard to the effectiveness of enforcement. Do not underestimate your employer; they can be caught.

Your Rights as a Worker 

The UAE worker rights on midday break are straightforward: You can legally refuse to work during ban hours. There are no disciplinary, threatening or firing policies in place to prevent workers from declining to provide outdoor services during the hours between 12:30 PM and 3:00 PM from June 15 to September 15.

If your employer:

  • Pushes you to work at times when you would not normally work
  • Does not provide shade or rest or water facilities
  • Threatens you for not working in the heat

…they are violating the law, and you can report them.

How to File a Complaint Against Your Employer (MOHRE Complaint Process) 

The process of filing a complaint is easier than most think it is. Here are all the ways in which you can do it:

1. MOHRE App (Fastest Option) 

Use the MOHRE app (available for iOS and Android) and access the complaints section to report your complaints directly. This can be done in several languages.

2. Call 800-60

The toll-free hotline of the Ministry is open 24 hours a day. Please dial 800-60, describe the situation and one of the representatives will help you through.

3. Online Portal

Make use of the online complaints system at mohre.gov.ae. Emirates ID or labour card information will be required.

4. Go to a MOHRE Service Centre

For face-to-face assistance, visit any of the MOHRE Customer Happiness Centres. Staff are available to assist you in making the complaint and to explain your rights.

The information you need to be prepared with:

  • Details about your employer’s name and company
  • Your work location
  • The date and time of the violation.Date and time of the violation.
  • If you have any photos or videos, please include them (very helpful)
  • Your Emirates ID or labour card number

What Happens After You File a Complaint? 

Any complaints may be made via the complaint process set out by the MOHRE (Ministry of Health and Medical Services) once they are submitted:

  • The ministry keeps your record and will check it out.
  • The inspector can walk around the site of the work.
  • If there is a proven violation, the employer is fined
  • Your identity can be kept confidential during the process

Don’t think that you will lose your job because of reporting. The UAE workers’ rights include protection against taking any action against them for filing legitimate complaints.
