Why Are the PeaceHealth Job Cuts Happening?

PeaceHealth IT job cuts are a result of its decision to consolidate technology services overseas as part of a business-saving measure now being implemented by many large healthcare networks to lower expenses. The system is moving IT roles to an Indian company and its U.S. subsidiary as a third-party managed services solution, thereby replacing in-house employees.

This is a business decision, not a performance issue. For those of the PeaceHealth 150 IT workers who are being laid off, it can mean the difference between a job and no job, and between being eligible for unemployment benefits and being ineligible.

The PeaceHealth workforce reduction impacts the most in Vancouver, followed by Bellingham, Longview, Sedro-Woolley and Springfield, Oregon. PeaceHealth was one of the larger IT job layoffs in the Pacific Northwest this year.

Your Rights Under the WARN Act

A federal Worker Adjustment and Retraining Notification (WARN) Act notice has been issued to state officials because of a mass dismissal of 50 or more employees at one facility, as required by law. This will enable PeaceHealth staff to have 60 days’ notice, or comparable payment and benefits if that notice was not given in full, of the November 20 cuts.

The example of PeaceHealth employee rights under WARN is as follows:

  • You have a right to be told in writing the date of your layoff and why you have been laid off.
  • Failure to comply with the 60-day period could mean that you are entitled to back pay and benefits for the period of noncompliance.
  • WARN notice filing is a public record; you can check on your state’s workforce agency website.

Your next step: If you don’t see a written notice, ask your HR department to send one to you. Record the date it was given to you. If the 60-day rule was not followed, speak with a labour attorney, as you may be entitled to more than what you were offered.

Severance, Benefits, and Unemployment

Details of the severance package will be dependent on your role, length of service and employment contract. Severance doesn’t have to be offered, but many big healthcare employers do provide it — inquire directly with HR about how it is apportioned, timing, and, most importantly, whether signing up for severance entails signing a separation agreement or waiving the right to file a lawsuit.

Some questions to ask HR before you leave:

  • How is severance determined? (i.e., weeks of service per year.)
  • Does severance payment delay or lessen unemployment benefits?
  • Do they include any non-compete or non-disclosure agreements?

On health care IT jobs: You will be able to continue your employer’s health care coverage for up to 18 months after the termination date, but you will have to pay the full premium, which can be a lot. Compare with ACA marketplace plans that could cost much less depending on your household income.

Washington State usually mandates that any vacation time not used be paid out when you retire. Verify with HR prior to November 20.

Washington: Workers in both states are likely to be able to claim UI benefits, as long as their employment ends. File for UI benefits as soon as your job ends so benefits begin as soon as possible.

What to Do Before November 20

Don’t delay moving until the week of November 20. Your runway is the time between now and the end date of your term – make the most of it.

  • Have it all in writing – severance terms, final date of pay, benefits end date and a letter of termination.
  • Make sure your resume is up to date now, before you can no longer access your work email, project files, accomplishments, etc.
  • Ask for a reference letter before your final day, instead of after; it’s harder to get after you leave.
  • Back up personal files from any work devices you’ll lose access to on or before November 20
  • Check your 401(k) – see if you’re vested and consider the possibility of a rollover to save on penalties.
  • Make sure to connect with your professional network early: Many of the healthcare and related IT positions are filled by referral.
  • File for unemployment as soon as you’re fired; don’t wait —Don’t procrastinate filing for unemployment — do it immediately after getting fired.
  • If you feel something is missing or amiss in your notice, severance offer or last pay, consult your labour attorney.
