Instacart Settlement: Do US employees get paid for jobs they didn’t apply for?

instacart settlement

(C): X

It was announced on 20th October 2026 that an agreement had been reached with Instacart and that some employees in the US may be able to get paid. The department of justice (DOJ) and the equal employment opportunity commission (EEOC) said the parent company of Instacart, Maplebear Inc., will pay up to $5 million following allegations of hiring discrimination against U.S. workers. Payment could go both to those who applied and to those who did not apply because of that.

Key Highlights / Quick Facts

  • Total settlement: up to $5 million
  • Employer liability: up to $4 million for any individuals who were impacted by the employer and/or discouraged from applying to the employer because of the situation.
  • Fines of $1 million to the U.S. government.
  • Effective: Oct. 20, 2026
  • Product involved: Maplebear App (Instacart)
  • Problems: additional requirements on the PERM application process for the green-card recruitment.
  • Who to contact: [email protected]

What Triggered the Instacart Legal Case?

Researchers studied the practices of Instacart in hiring for jobs advertised through the Permanent Labour Certification (PERM) process, which many companies are required to go through for foreign workers who want to apply for a green card. For these jobs, applicants were required to submit applications via USPS, the DOJ said. Instacart is a company that has a regular hiring process, and online applications are accepted.

The DOJ said this additional requirement made it more difficult for U.S. workers to be considered, and many were not considered in a timely manner. The EEOC reported that it also discovered similar evidence. The agencies’ policies conflicted regarding the legality of the practice, with both sides claiming it violates the Immigration and Nationality Act and Title VII of the Civil Rights Act of 1964 (which prohibits discrimination on the basis of citizenship status and national origin).

Who is Eligible for Settlement Compensation?

It is not a standard class action, nor is it a delivery shopper, gig worker or anything else. It is the issue of office-type positions that are advertised out during the PERM process. The claims administrator will send letters to applicants who may have been impacted and determine which ones are entitled to back pay and compensatory damages. If you experience any of these symptoms:

  • You submitted your application to a position that was advertised under the PERM, and it was either overlooked or not responded to in a timely manner.
  • You didn’t apply for a job because it was a paper application
  • You feel you were treated unfairly, relative to temporary visa holders

How to Raise a Claim

If an applicant believes he or she was impacted, he or she may write to [email protected]. The agencies will share their information with the claims administrator. This announcement did not list the amount of payouts per person publicly, so the compensation will be dependent on each person’s situation. Maintain any documentation you have, including job ads, email and application dates.

What Instacart Must Change

In addition to the payments, the company has pledged to implement a number of changes:

  • Post relevant jobs on its public Careers site
  • Accept e-mails while on the PERM recruitment process
  • Revise its employment policies
  • Provide staff training on anti-discrimination rules and standards.
  • Address monitoring and reporting needs.

Why This Matters for US Workers

It is part of the DOJ’s “Protecting U.S. Workers Initiative” program that was launched again in 2025 in response to employers who discriminate against US workers by showing favoritism towards those with temporary visas. It was the 15th such agreement signed during EEOC Chair Andrea Lucas’ tenure, and EEOC Assistant Attorney General Harmeet K. Dhillon said the EEOC will take action against such employers.

In the eyes of the job-seeker, the message is that US workers should be given a fair opportunity to apply for recruitment through PERM. If it’s a posting that is difficult to apply for, it may be worth documenting and reporting.
