Great US Visa Freeze: Why Tech Expats Face a Massive Green Card Blockade Until October 2026

This summer has been a letdown for thousands of highly skilled professionals hoping to get permanent residence in the United States. According to the July 2026 Visa Bulletin, the employment-based EB-2 category for Indians and the “unreserved” investor category EB-5 are listed as “Unavailable until the beginning of the next Fiscal Year on October 1, 2026.

Why Has the US Visa Freeze Happened?

Any visa that remains surplus once 2267 are awarded for the year are cancelled and cannot be renewed until more visas are available in October.

Applicants are not prohibited from maintaining their existing lawful immigration status, although USCIS has indicated the following: If applicants are able to get a Green Card after allocation, they might still be examined by USCIS.

Significantly, these petitions are not being withdrawn in the face of the freeze. Rather, applications are held until the visa numbers are reopened on October 1, 2026.

Other Visa Categories Facing Pressure

While the months of July are reserved for the receipt of EB-2 India and EB-5 unreserved visa applications, these visas may experience rising demand also from immigration officials.

Demand may continue to grow and result in retrogression or temporary restrictions in the EB-2 (China) and EB-3 (Philippines) categories before the FY-end. Persons in these categories are being encouraged to keep a close watch on future Visa Bulletins.
