UK Employment Rights Bill 2026: Day-One Worker Protections, Sick Pay and Key Changes Explained

UK Employment Rights Bill 2026 – What Is It?

Why The New Reforms Came In

Family Leave Rights On Day One

One of the major reforms is the new extended day one family leave entitlements. The reform forms part of a wider policy objective to support work-life balance and remove barriers for new employees.

Paternity Leave For Bereaved Partners

The legislation includes a new entitlement to Bereaved Partner’s Paternity Leave. This provision recognises that families can face exceptional personal circumstances and supports eligible employees following the death of a child’s mother or primary adopter.

Statutory Sick Pay – Key Changes

The Employment Rights Act is a major reform of the UK’s Statutory Sick Pay regime.

Previously, employees had to wait 3 qualifying days before getting SSP. Under the new legislation, this waiting period has been eliminated. The reform is designed to reduce interruption to income for employees who suffer short-term or unexpected health problems.

Abolition Of The Lower Earnings Limit

Another big change is to open up access to Statutory Sick Pay by removing the old lower earnings limit. Many lower-paid and part-time employees who were not previously entitled to SSP may now be entitled to statutory payments during sickness absence.

Sick Pay Calculation Update

The law also creates new ways to calculate pay for some of the lowest-paid workers. Statutory Sick Pay is calculated at the lower of 80% of your average weekly earnings or the standard statutory weekly SSP rate for eligible employees.

Fair Work Agency Intensifies Enforcement

The legislation is supported by a key institutional reform, the creation of the Fair Work Agency. Early compliance helps employers to minimise legal risks and create good relationships with their employees at the workplace. Human resources teams will have a particularly important role to play in implementing the updated rules across organisations.

Amendments To Redundancy Procedures

The legislation also introduces stronger measures concerning collective redundancy consultations. The financial penalties for not meeting consultation requirements have been increased. The reforms encourage open consultation with employers before large decisions on cutting workforces are made.

Changes To Trade Union Recognition

The Employment Rights Act also amends procedures for recognition of trade unions. The recognition thresholds have been simplified to ease some parts of the process while keeping the existing legal protections for employers and employees. Later Changes To Be Made To Unfair Dismissal

There was a lot of public debate about day-one unfair dismissal protection during the passage of the legislation, but this reform has yet to be implemented. Changes to qualifying periods for unfair dismissal claims are not coming into effect straight away but are anticipated in early 2027 under current plans.

The rights to immediate family leave, first day Statutory Sick Pay and extended SSP cover give employees greater financial and workplace security from day one of employment. Employee handbooks, payroll systems, processes for managing sickness absence, family leave policies and management guidance will all need to be reviewed by human resource departments to ensure they are compliant with the new legal requirements.

The UK Employment Rights Bill 2026 is the biggest change to employment law in years.
