The first few months of a new job are tense for almost everyone. You want to impress, you don’t want to rock the boat, and you’ve probably heard someone say you have no protection until probation ends. That isn’t true. Your probation period rights start on day one, and basic employment law applies to you in Lagos, London, Dubai or Delhi alike.
What Is a Probation Period?
Think of it as a test drive. For a set time, usually one to six months, the company sees how you do the work and you see whether you like it. Your contract should say how long it lasts and how much notice each side must give. If it doesn’t, ask before you sign.
What Employers Can Do During Probation
Employers are allowed to:
- Set targets and check your progress often
- Train you, or ask you to improve in areas that need work
- End the job with notice if agreed standards aren’t met, following local rules
- Extend the trial, but only if your contract allows it and they tell you in writing
- Hold back extras like bonuses or private health cover until probation is over
- Give a shorter notice period than permanent staff get (shorter, never zero)
What Employers Cannot Do and What You Should Watch For
A trial period gives a company room to decide. It doesn’t give them room to treat you badly. Employers cannot:
- Let you go because of your religion, gender, race, pregnancy, disability or union membership, which is unfair dismissal or discrimination
- Pay less than the legal minimum wage
- Keep pay or overtime you’ve already earned
- Skip basic safety rules
- Change your agreed terms behind your back
- Punish you for making a fair complaint
If something feels off, don’t wait:
- Keep your contract, offer letter and payslips somewhere safe
- Send a short email after each review so there’s a written record
- Jot down dates, names and what was said
- Ask HR, a trade union or your national labour office for advice
Rules change from country to country. Some places protect you fully from the first day, while others add protection after a few months, so check what applies where you work.
