China is toughening up its measures against retired workers. The new system establishes a stronger legal framework for continued working after retirement, while providing better protection for those currently working after retirement age and new compliance obligations for employers.

Key Protections for Over-Age Workers

The Interim Measures on the Protection of Basic Rights and Interests of Over-Age Workers requires employment agreements to be drawn up in writing and contain a range of conditions, including job responsibilities, the length of the workday, work pay, workplace safety, and more.

Another part of the framework deals with wages and hours. Compensation must meet local minimum wage requirements and hours of work and overtime must be in line with statutory requirements. These requirements have lowered uncertainty of informal post retirement parties.

Work Injury Insurance

Most of the biggest strides occur in the field of work-related injury protection. Employers must provide workers over age depending on insurance in the event of work injuries, and have to cover the employer liability.

This gives a necessary protection when a post-retirement worker is affected by an accident on the job or by their work. Nevertheless, it also provides companies with a more framework-oriented approach to dealing with risks that come with hiring seniors.

Labor Dispute Protection

The new judicial environment also offers more clarity and guidance for cases involving over-age labour. Inside matters related to remuneration, working conditions, working hours and rights related to employment, the labour-dispute mechanisms can be used more structured, provided those rules applicable to the jurisdiction are in force.

This bodes well for businesses, as post-retirement can no longer be looked at as hand, foot and mouth service alone. Documentation and compliance procedures are gaining in magnitude in significance.

Future Work Force and Retirement Reform

These protections are even more important, as China has been steadily raising the retirement age of its workers. With increased opportunities for the older workforce to stay economically productive, there is an urgent need for strategies to address the need to manage older workers in a way that is safe, fair and legal within the workplace.

What Employers Should Do?

It is important for companies to check arrangements with the post retirement staff, check local wage requirements, record working hours and overtime, and confirm the procedures for work injury insurance. Compliance reviews can cut down on disputes as well as operational risks if carried out regularly.
