Know Your Rights: Police Checks vs. Immigration Raids in Milan

Coming out in the streets of Milan as a foreigner, one needs a clear knowledge of Italian laws on security. A standard stop and a targeted operation are two very important concepts which should be separated. In Italy, the police have the right to search anyone to check his/her identity and status. Italian officers enjoy wide discretion as opposed to some jurisdictions where probable cause is strictly determined. In the case of non-EU citizens, it will imply that you will be ready to demonstrate your legal residency at any given time. A regular control is often a fast one, but when appropriate documentation is not present, the situation may escalate into a detention to identify, which is not the same as the dangers of deportation immediately that facilitate bigger organized raids.

Carrying a Valid Residence Permit

In the Italian law, non-EU citizens are required to carry their Permesso di Soggiorno and passport. A backup of the digital copies is always advisable, but it should be noted that the hardcopy evidence is always required in such kind of inspections.

Always remain calm and polite during a stop. If you are taken to the station for an Identification Procedure, you have specific protections. It is also your right to know the documents that are presented to you, never sign what you do not understand and make sure that there is an interpreter in case one is needed to make sure that your details are correctly documented.
