The “safety net” has been lifted if you are waiting on an EAD renewal and your Employment Authorisation Document is soon to expire. The Department of Homeland Security has abolished the 540 Day EAD automatic extension, which was the previous practice of continuing to grant eligible immigrants their EADs to work while their Form I-765 renewals are pending. This is more than an administrative adjustment for hundreds of thousands of workers; it’s a threat to their livelihoods.

What Was the 540 Day EAD Rule?
This automatic extension of authorization to work was included in the bill because of the protection of immigrants against the consequences of the USCIS’s delay in issuing an EAD. As a result, by submitting the EAD renewal application before its expiry date, you automatically got temporary authorization to work, and it lasted for up to 540 days.
It was a real issue because USCIS had so many processing delays for work permits that hundreds of thousands of people were unable to work legally while they were at the stage of renewing their work permit with USCIS.
What If Your EAD Expires?
As of now, the changes to the EAD were made permanent, and there was no buffer. Work permit expiration is a work authorization gap, with immediate consequences if you are due to work when your permit expires before you get a new one.
- Working is not permitted. If you continue in your job with an expired work permit, you are in danger along with your employer.
- Records of I-9s will need to be updated by your employer. Employer I-9 verification rules require re-verification when the EAD expires. The employer may be liable for penalties if action is not taken.
- EAD expiration and job loss is a possibility – and many employers won’t even have the patience to wait for valid documentation of an employee’s work eligibility, even for a few months.
The only thing that would prove a filed renewal is a notice from USCIS that your EAD was renewed — but, under the new rule, that notice would not provide you with the right to work.
Who Is Most at Risk?
The eligibility requirements for the EAD category impact people most strongly in certain categories:
- Spouses of H-1B holders – including a large number of Indians — eligible for renewal of their H-4 EAD status
- Spouses of the employees on L-1 visas (L-2 EAD holders)
- Asylum seekers who seek to renew their EADs.Applicants who renew their EADs on the basis of asylum.
- Eligible applicants who are currently pending adjustment of status (EAD) holders who have had their cases pending for more than a year.
The USCIS delays in employment authorisation renewals are not an inconvenience for these workers, but a direct result of a lapse in employment authorisation and even an EAD expiration and job loss.
What Can You Do?
- File the documents in 180 days. But now you have one renewal period as your cushion.
- Track your status. Check the USCIS website often for updates on your pending renewal status.
- Prepare your employer. Provide HR with the work permit renewal schedule to allow for planning of I-9 re-verification.
- Seek legal counsel, particularly for H-4 EAD renewal and applications with the longest processing times for L-2 EAD renewal.
FAQs
Does my EAD receipt notice allow me to continue to work?
No. The automatic EAD extension policy by USCIS has been lifted. EAD renewal receipt notice is not a work authorisation. An EAD is required to work and cannot be expired.
What are USCIS EAD processing times at this time?
As of June 2026, more than 432,000 employment authorisation renewal applications were pending, and 91,000+ have been pending for over 18 months. Processing of work permit applications in USCIS continues to be very slow.
May I disagree with the rule?
A previous court order in California had prohibited the interim order for some H-4 visa holders. An immigration attorney can guide you on whether a legal challenge is appropriate or not.
