US Work Permit Rule Change: H-1B Spouses Could Lose Work Authorization During Renewal Delays

us work permit rule change

(C): X

H-1B families are in a bind due to sweeping changes in US work permit rules. The 540-day automatic extension for workers with pending employment authorisation document renewals is no more. It is indeed a very big risk for H-4 visa-holders (generally the spouses of H-1B visa holders), as they are not able to continue working as they are not legally allowed to do so until their applications get processed at USCIS.

What Changed — and Why It Matters

The Biden Administration allowed workers whose renewals were pending an automatic extension of their H-4 EAD up to 540 days. This was a workable solution: processing delays at USCIS for EAD applications kept employees waiting for more than a year to hear back, and an extension was the only way they would be able to avoid waiting longer if their EAD application were denied.

This is no longer the case. The new immigration policy modification is permanent, rather than interim, as the one that was issued last year. The revised U.S. employment authorisation regulations have been criticised as just a new way to leave work authorisation gaps in the U.S. system that can be exploited by H-1B spouse applicants, while DHS claims they provide for more frequent vetting of applicants.

FWD cannot submit applications to renew FWD until 180 days prior to their expiration. As of mid-2026, there were over 91,000 H-4 EAD applications that were pending for more than 18 months, and it simply doesn’t sound like things are going workers’ way.

How H-1B Spouses Are Directly Affected

The H-1B spouse work authorisation has always required the H-4 status to be valid and have a current EAD. Allowing the rule change directly strikes at the employment rights of H-1B visas held by the spouse of an H-1B visa holder, which thousands of families have relied on to build careers. The old system provided a valuable safety margin. The new rule removes all of that buffer from the strips.

The new USCIS H-1B/H-4 work permit renewal guidelines are now considered new applications and will be reviewed as such, with all the new requirements, paperwork, and the possibility of refusal – even for those who have been working in the same position, for the same employer, for years. A major update to work authorisations for immigration to the US – it has an impact on H-1B dependent spouse work rights fundamentally.

Practically, this means:

  • More requests for evidence (RFEs)
  • Increased time between the expiration of H-4 and approval
  • Job security worries of the H-1B spouses increase
  • Employers who have the risk of not being in compliance while workers are engaged in the renewal process.

The Backlog Problem Isn’t Going Away

The primary reason for the delays in H-4 EAD renewals has not changed: USCIS processing times continue to be slow, and hundreds of thousands of people continue to be impacted by delays in renewal of their U.S. work permits each year. The backlog for renewals of employment authorisations is currently more than 432,000. There is no need to remove the automatic extension to speed up processing times – just to remove the safety net that had been in place while workers waited.

A group sued the interim version of this rule, fearing that H-4 visa holders’ work eligibility was being undercut by means of an inadequate legal process, declaring that this infringed on the Administrative Procedure Act. In California, a court agreed with them, holding that the rule was not properly followed or that it did not consider the reliance of applicants on the extension established. Such litigation continues, but the new permanent rule continues to move forward.

FAQs on US Work Permit Rule

What is the automatic extension of H-4 and why was it taken away?

Under the H-4 EAD automatic extension rule, which came into effect on January 22, 2010, H-4 visa applicants could stay in the U.S. for up to five years pending the processing of their H-4 EAD application requests. It was taken away by DHS to enable more regular vetting, but critics say there is a danger of creating dangerous unfilled work authorization periods for the partner of an H-1B worker when USCIS backlogs exist.

How does the new rule affect H-4 visa work permit holders specifically?

Applications to renew an H-4 visa are now considered new applications, including a full review of documentation. Along with these, the delay in the processing of the EAD in 2026 will increase the chances of having an employment gap for the spouse.

What do H-4 EAD holders need to do now?

Apply for renewal of H-4 EAD at least 180 days in advance. It is important to keep monitoring the expiration date of your H-4 EAD and seek the advice of an immigration attorney if you are within six months of the expiration date – particularly in light of the current processing times for USCIS EAD renewal.

Will U.S. restrictions on work permits become more stringent?

There might also be some changes to the employment authorization of spouses because of some other policies regarding immigration coming into effect in the U.S. in 2026. It is, therefore, very important that the H-4 EAD policies and other policies related to U.S. immigration work authorization are taken into consideration by any H-1B family.
