Investment Canada Act and Stelco Layoffs: Can the Government Enforce Its Job Protection Commitments?

stelco layoffs

(C): X

Is it possible for the government to implement the job protection obligation? Yes, it is. Ottawa can demand for compliance, ask for the order of the court to be issued in accordance with the Investment Canada Act, and impose financial penalties. Yet, it is what is promised, and that is the matter of dispute at Stelco.

Quick Facts

  • What happened: Up to 500 jobs would be cut at Stelco’s Hamilton facility and elsewhere, and the layoffs would be gradual – in a three-week period.
  • The promise: Stelco was acquired by its U.S. parent in 2024, and the employment assurances were offered until 2029.
  • The dispute: Ottawa accuses Stelco of breaking those promises, while Stelco denies the violation of the promises.
  • Next step: Ottawa is readying for the litigation process, and Stelco is ready to sell off.

What Happened at Stelco?

Federal officials threatened the company with legal action unless it came up with a plan on how to save the jobs. The company would not stop. “Stelco Hamilton layoffs are temporary due to 50 per cent US steel tariffs and workers will return when a trade deal comes to fruition,” it states.

How the Investment Canada Act Protects Canadian Jobs

Foreign deals may need to be approved, and often buyers make employment commitments to secure approval. The government has the power to issue a demand, seek a court order and impose penalties if a foreign investor fails to keep those promises. The catch is the problem with the words. Conflicts may arise if either the commitment is to a constant headcount or an average.

Why It Matters for Steelworkers

The security of steelworker jobs impacts entire communities, including suppliers and shops around the plant. A robust ruling may provide foreign investors hope that they’ll be treated as their word. A weak one might allow Canadian steelworkers’ rights to be an empty promise.

What Happens Next?

Beware of a court battle or a compromise. Employees who are affected should talk to their union and retain all layoff paperwork.
