Australia Cracks Down on ‘Visa Hopping’: New October 2 Rules Target Onshore Student and Work Transfers

Australia has implemented significant reforms to its Student visa program including stricter onshore visa requirements and for family members. The reforms will aim to limit visa hopping, the practice of temporary visa holders seeking multiple visas to live in Australia for a longer period of time for an immigration objective that is not the one for which the visa was originally granted.

The alterations are in response to the policy being issued when the Migration Instrument 2026 was registered. It supersedes the previous visa and identifies temporary visas holders who will not be able to submit Student visa applications in Australia.

Stricter Rules for Onshore Student Visa Applications

As of 2 October, the majority of Student visa applications will be made from overseas. LIN 26/102 applies to those with specified temporary visas – such as those with multiple work and/or visitor visas. The government claims the measure will help curb temporary migrants arriving on visas for non-study reasons hanging onto Student visas to extend their visas.

The official Home Affairs guidance also contains confirmation that the person whose Student visa has been granted is in the process of obtaining it while outside Australia. They might be able to return to Australia on another visa if an application is made to be processed offshore but an offshore visa does not generate a Bridging visa.

Course Progression and Family Rules Tighten

There is a general prohibition on people who are current Student visa holders from applying for a Student visa again in Australia unless they satisfy a specific exemption. 

Other exemptions permit advancement to a higher AQF level after completion of the core course, with limited exemptions consisting of a few postgraduate degree research students, as well as DFAT or Defence sponsored students and school students.

Family chains of migration are also more constricted. Partner and/or dependent children are not available as subsequent entrants for students who have received their visa. Selected applicants can have attended the same residence, family members.
