H-1B Visa Program Faces Scrutiny as 2026 Filing Season Begins

When H-1B visa applications for 2026 opened up in this period people against immigration focused their attention on H-1B visa recipients because they claim foreign workers take jobs meant for U.S. residents. Despite major pushback, the USA intends to give out more visa slots through the program to find overseas employees of exceptional quality.

From April 1 on the selected petitioners should send their H-1B cap-subject applications within a three-month deadline. Each fiscal year Congress allows work visas through the H-1B program at 65,000 cap-subject slots plus 20,000 more for people with advanced degrees.

H-1B program benefits a majority of employees in the United States from India plus numerous professionals from other countries. A new Atlantic Council research points out that evidence does not support allegations H-1B visa holders take away US jobs or lower salaries.

According to the report:

  • H-1B visa holders constitute only 0.5% of the U.S. workforce
  • Between 2003 and 2021, median wages for H-1B workers grew 52%, outpacing the 39% increase for all U.S. workers
  • Studies indicate that the increased presence of H-1B workers in an occupation correlates with decreased unemployment in that field.

Those who enter the U.S. on H-1B visas help America create new ideas and produce the important artificial intelligence tools needed to keep America as an engineering leader. The success of this program depends on changes that will happen during Trump’s presidency. Under his first presidential term President Trump launched his “Buy American Hire American” order that heightened scrutiny of H-1B applications that led to 20% filing denials in 2018. Everybody predicts changes that might limit business access to worldwide talent through government policies and administrative directives.
