What Is the Einstein Visa? A Guide to O-1 and EB-1A Eligibility and Process

While the U.S. intensifies scrutiny over traditional visa options like the H-1B, high-skilled workers have turned to elite alternatives like the O-1 visa and EB-1A visa, also called the “Einstein Visa, ”which are for persons of extraordinary ability in the fields of science, education, arts, business and athletics.

O-1 Visa: Temporary but Prestigious

The O-1 visa is a non-immigrant path for those who have received national or international recognition for extraordinary ability.

The O-1A can be used for individuals who are in the fields of science, education, business or athletics.

The O-1B is for individuals in film and television (e.g., actors, directors, etc.) or individuals in the arts.

The O-1 visa usually allows for a stay of three years with the opportunity to apply for extensions. An important highlight is that there is no annual limit to the number of O-1 visas granted, and there is a high approval rating of about 93%. The downside is that the cost may range from $10,000 to $30,000. In the last year a total of over 22,600 O-1s were received; however, in 2023 there were only 18,894.

EB-1A: The Einstein Visa

The EB-1A is a green card (immigrant visa) application for individuals with “extraordinary ability” and a record of national or international acclaim, such as a Pulitzer Prize winner, Olympic medallist or recipient of an Oscar. All applicants must file Form I-140 and provide evidence that meets high evidentiary standards.

The EB-1A is a direct permanent residency path and is highly desirable as an alternative to the H-1B.

With this increased scrutiny, specifically social media vetting for many professions, many professionals are looking at elite pathways to create a smoother entry to the U.S.
