China’s New Gig Worker Protection Rules: Employment Rights, Social Security Benefits and Platform Responsibilities Explained

Authorities are also expanding pilot programs that make it easier for gig workers to access pension and medical insurance systems. Generally, eligibility is determined by minimum participation requirements based on accumulated working days with one or more digital platforms within a financial year.

New Rules Increase Platform Responsibilities

The new rules also set out clearer obligations on digital platforms, beyond paying wages. The reforms also remove the possibility for businesses to dodge responsibility by simply labelling workers as independent contractors.

Working Hour Limits Are Intended To Improve Safety

Long working hours are a key concern across many parts of the gig economy. Workers often agree to work longer shifts to make more money. Delivery workers and ride-hailing drivers often work in severe weather because their income is directly linked to the number of gigs completed. The new rules expand protections by requiring platforms not to penalise workers who stop work during severe weather conditions. Heavy rain, storms, extreme temperatures and other hazardous conditions can greatly increase occupational risks.

Standardisation Of Platform Economy By 2027

But China’s ambition is not limited to individual reforms. Authorities have said they plan to standardise employment practices in the platform economy by 2027. Standardisation aims at harmonising the rules regulating labour in the following areas: contracts, wages, insurance, algorithm management, workplace safety, and dispute resolution. The reforms mark a major turning point in the governance of China’s digital labour market. Better worker protections could increase operating costs for some platforms through higher compliance requirements and wider employment responsibilities apart from insurance contributions.

But better labour standards can also lead to a more stable workforce, reduced turnover, safer working conditions and increased public confidence in platform-based employment.

China’s latest reforms are an attempt to strike a balance between technological innovation and stronger labour protections in one of the world’s largest digital economies.
