West Bengal State Employees to Receive 25% DA Following Supreme Court Verdict

Dearness Allowance is an adjustment for the cost of living for professionals and pensioners employed by the government to allow them to cope with increasing prices, inflation etc.The Dearness Allowance is usually a percent of the basic salary or pension offered to government employees or pensioners. It is usually reviewed periodically based on economic indicators.

On May 16, 2025, the Supreme Court of India ordered the West Bengal government to pay 25% DA to its state government employees within three months. An interim verdict was delivered by the Supreme Court bench led by Justices Sanjay Karol and Sandeep Mehta. The matter is scheduled to be discussed again in August for a final decision.

The case began in 2022 when a group of employees from the state of West Bengal raised an application with the Calcutta High Court for parity with employees from the central government and include arrears. The High Court made a decision in favor of the employees ordering the state to match central DA rates which resulted in the state challenging that decision in the Supreme Court. West Bengal decided to appeal the High Court’s decision and had filed that appeal in the Supreme Court in November 2022.

Since then the state government has granted a series of incremental DA increases but has not matched the central government’s rate of 55%. As of April 1, 2025 West Bengal employees receive 18% DA, a 4% increase from 14%. This reflects a difference of 37% from the state to the central rate which is causing dissatisfaction among more than 1 million employees and pensioners of the state.

The recent order of the Supreme Court to release 25 percent DA in three months has given a partial remedial justice to the employees but they are still waiting for complete justice regarding parity with the central government. However, DA is still an integral part of the compensation from the Government and reflects the tenuous divide between financial realities and employee welfare.
