Hong Kong Director Faces HK$90,000 Fine for Employment Violations

The director of Hong Kong-based The Boring Engineering Limited received a HK$90,000 fine from the Kowloon City Magistrates’ Courts because both he and the firm violated many rules in the Employment Ordinance.

According to court judgment the company director intentionally refused to send the employee their HK$36,000 wages in lieu notice at the end of their employment term. The director refused to follow a required Labor Tribunal decision to pay HK$214000 within the given 14 days.

Following his admission of guilt, the court required the director to pay the entire HK$214,000 owed to his employee.

The Labor Department representative confirmed the authorities’ dedication to enforcing employment rules through this decision, which strongly warns violators.

The legal rules for employment notice periods apply to every employer in Hong Kong:

  • People who work past their probation phase at work have the right to receive payment instead of receiving an official notice
  • Continuous contract workers receive equal labor rights just like those who completed probation terms.
  • A worker’s payment will depend on the full notice period duration.
